What you need to know about the Biden-Harris immigration program: 

The Biden-Harris administration has announced the expansion of parole-in-place and D3 protections for spouses of US Citizens and Dreamers. This program falls far short of creating a pathway to citizenship for all immigrants, but it has the potential to be the biggest step forward since DACA was passed a generation ago. 

Here is what we know so far: 

  • Applications are open for Parole in Place but a Federal Judge in Texas has issued a stay which stops USCIS from implementing the law for now. 
      • If an individual is granted PIP, they will be protected from deportation for 3 years and can apply for a work permit. Most importantly, PIP recipients will be able to apply for permanent residence (a green card) through their spouse in the United States without having to leave the U.S. to have an interview at the consulate in their home country.
      • Final Parole in Place (PIP) guidelines will be updated when registration opens on August 19th and the updated D3 guidelines are still pending
  • In order to help all eligible people take advantage of this program; the Work Permits for All coalition will be hosting a free screening and registration session on August 19th to help community members determine if they’re eligible for the program. 
  • The opening date for applications for D3 adjustments has not yet been announced. 
  • If you think you or someone you know may be eligible, it’s important that you attend one of these official registration events so that you don’t risk being misled by scammers.

BEWARE OF SCAMMERS

Notarios or other scammers take advantage of changes in immigration law to defraud immigrants in need of help. Contact a reputable organization like  The Resurrection Project, the Chicago Workers Collaborative, the National Immigrant Justice Center, or a private immigration attorney before submitting anything to U.S. Citizenship and Immigration Services (USCIS), or any other federal agency.

You May Be Eligible If You…

  • Are present in the United States without admission or parole;
  • Have been continuously present in the United States for at least 10 years as of June 17, 2024; and
  • Have a legally valid marriage to a U.S. citizen as of June 17, 2024.
  • Do not have disqualifying criminal history or otherwise constitute a threat to national security or public safety
